Terms and conditions of the online store Slavica Yarns

Defining among others, the rules of concluding sale contracts by the store, including the most important information about the Seller, the store and consumer laws.

§ 1 DEFINITIONS
Work days – days from Monday to Friday excluding days statutorily free from work (in Poland)
Account – a free service of the Store (a service provided inline) regulated with a separate regulation, thanks to which the buyer is able to create his own private Account in the Store.
Consumer – A consumer as defined by the Civil Code
Store – the online store Slavica Yarns, managed by the Seller under the address http://slavicayarns.pl.
Seller - Slavica Yarns - Szymon Jergas located at Dziatwy 14C/21, 03-109, Warsaw, Poland, added to the National Court Registry – registry of entrepreneurs under NIP 6452486234, REGON 382636041

§ 3 TECHNICAL REQUIREMENTS
1. To make the store function properly, you will need:
• A device with an internet connection
• And internet browser capable of operating JavaScript and cookies
2. To place an order in the Store, except for the requirements from paragraph 1, you are going to need an active e-mail address

§ 4 SHOPPING IN THE STORE
1. The prices visible in the store are total prices, including VAT
2. We inform you that the full value of your order consists of the price of wares (skeins of yarn) and the shipping fee.
3. The chosen items have to be placed in the cart in the Store.
4. Next, you have to choose a method of delivery, a method of payment and provide all personal information necessary to send out your order.
5. An order will be placed when you accept its contents and our terms and conditions of service.
6. Placing an order is identical with concluding an agreement of sale between the buyer (you) and the seller (the store).
7. We will provide an official confirmation of said agreement on paper not later than the day of delivery.
8. You can create a personal account in our store or buy without registering by entering your personal data each time you place an order.

§ 5 PAYMENTS
1. A placed order can be payed using the method chosen by the Buyer:
a. By card
• Visa
• Visa Electron
• MasterCard
• MasterCard Electronic
• Maestro
b. Via dotpay
c. Via Paypal
2. In case of payments via card, the entity providing the payment service is Blue Media S.A.
3. All payments should be concluded in 7 workdays from the day of placing the order.
4. The Seller informs that in case of some forms of payment, due to its specification, it’s possible to issue the payment only directly after placing the order
5. The Buyer by placing an order in the store accepts the fact that the Store uses electronic invoices. The Buyer has the right to withdraw his consent to this.
6. Should the necessity arise to return funds for an order, paid via card, the funds will be transferred to the bank account associated with the card.
7. Each sale will be confirmed with a proof of purchase in the form of a receipt. The need for an invoice should be reported while making the purchase (best in the form of a comment to the order) before the receipt is printed because an invoice can only be issued to a receipt with the buyer's tax number on it. After a regular receipt (without the buyer's tax number) is printed, the issuing of an invoice to that purchase will no longer be possible.

§ 6 COMPLETION OF ORDERS
1. The seller is obligated to deliver the goods without flaws.
2. All orders will be shipped in no more than 2 work days
3. Should the Buyer order multiple items with different times of realization, the order will be shipped in the time it takes for the last item to be ready.
4. We deliver our goods on the terrain of the EU
5. The goods will be delivered via the postal service.

§ 7 RIGHT TO CONTRACT WITHDRAWAL
1. The Consumer may step back from a contract concluded with the Seller via the Store, with exceptions mentioned in 8, in 14 days.
2. The deadline to withdraw a contract is 14 days from the day:
3. The Consumer or a third person pointed out by the Consumer, other than the courier comes into possession of the ordered goods.
4. To take advantage of the right to withdraw, the Consumer must inform the Seller about his decision using the contact information provided in 2 of the terms and conditions, by sending an unambiguous statement.
5. The consumer may use the template provided at the end of these regulations.
6. To keep the deadline to withdraw a contract, the Consumer must simply file his decision before the 14-day deadline is up
CONSEQUENCES OF WITHDRAWING A CONTRACT
6. In case of a withdrawal of a contract the Seller refunds all payments received from the Consumer, including the shipping fee (with the exception of additional fees resulting from the shipping method chosen by the Consumer which is higher than the cheapest method of delivery that is available for the ordered goods), immediately, in any case not later than in 14 days from the day the Seller is informed by the consumer about his decision of withdrawing a contract.
7. The Seller will conduct the refund the same way the money was paid by the Consumer, unless the Consumer agrees to another way of refund, in any case, the Consumer will not carry any costs associated with the refund.
8. Should the need arise to refund a payment issued by card the Seller will transfer the funds to the bank account associated with the card used by the Buyer.
9. The Seller may delay the refund until he receives the complained items or confirmation of it being shipped. Depends on which one comes first.
10. The Seller asks to send the returned items to Dziatwy 14C/21, 03-109 Warsaw, Poland immediately, in any case not later than 14 days from the day the Consumer informs the Seller about the withdrawal. The deadline is kept if the Consumer sends the goods before 14 days pass.
11. The Consumer is obligated to carry the immediate fee for the return shipment.
12. The Consumer is only responsible for the reduction of the value of the goods that were caused by handling that was not necessary to determine the character, characteristics, and functionality if the goods.
13. Should it be the case that sending the items back via regular post is not possible, the Consumer will also have to carry these costs.

§ 8 EXCEPTIONS FROM THE RIGHT TO WITHDRAW A CONTRACT
1. The only entity entitled to the right to withdraw a contract is a Consumer.

§ 9 COMPLAINTS
1. Should an item be defective the Buyer has the possibility to file a complaint on the grounds of the Civil Code warranty or guarantee if one was issued by the Store.
2. Taking advantage of the warranty the Buyer may, following the rules and deadlines of the Civil Code:
3. File a declaration of price reduction
4. In case of a significant flaw – file a withdrawal of the contract
5. Demand to exchange the items to ones without flaws
6. Demand to remove the flaw
7. The Seller asks to file complaints on hand of the warranty via e-mail or the postal address seen in 2 of the Terms & Conditions
8. Should it be necessary to send the complained items back to the Seller in order to consider the complaint, the Buyer is obligated to deliver the items, in the case of a Consumer on the cost of the Seller, to the address: Dziatwy 14C/21, 03-109 Warsaw, Poland
9. If there is a guarantee for a product, this will be available in the description of the item
10. Complaints about the functioning of the Store should be filed via the e-mail address provides in 2 of the Terms & Conditions.
11. Complaints will be considered in a 14-day deadline.
EXTRAJUDICIAL WAYS OF CONSIDERING COMPLAINTS AND VINDICATING CLAIMS
8. In the case, where the complaints procedure did not bring the results expected by the Consumer, the Consumer may use among others:
a.Mediations conducted by the Provincial Inspectorate of the Trade Inspection, to which a motion must be filed. In rule, the mediations are free of charge. List of Inspectorates: https://www.uokik.gov.pl/wazne_adresy.php#faq595.
b.The help of the appropriate amicable consumer court functioning by the Provincial Inspectorate of the Trade Inspection, to which a motion must be filed to request a consideration of the case by the amicable court. In rule, the mediations are free of charge. List of amicable courts: https://www.uokik.gov.pl/wazne_adresy.php#faq596.
c.Free help from the city or County consumer spokesperson.
d.The online ODR platform is available under the internet address: http://ec.europa.eu/consumers/odr/.

§ 10 PERSONAL INFORMATION
1. The Administrator of personal information provided by the Buyer in order to use the Store is the Seller.
2. The personal information of the Buyer is being processed according to the general regulation of the European Parliament and the EU Board about data protection (GDPR). Detailed information about the processing of personal information is available in the Stores Privacy Policy site.

§ 11 STIPULATIONS
1. It is forbidden for the Buyer to provide the Store with illegal information.
2. Every single order placed in the Store is a separate contract of sale which requires a repeated acceptation of the store's Terms & Conditions. The contract is concluded in order and for the time to complete an order.
3. The contracts of sale concluded on hand of these terms and conditions are being concluded in Polish. The Seller (Szymon Jergas in this case) is obligated to provide any Consumer with a contract in English if requested.
4. In case of an eventual dispute with the Buyer which is not a Consumer, the appropriate court is the court situated in the location of the Store.
5. Neither of the provisions stated in these Terms & Conditions takes away nor reduce the rights of the Consumer which are determined by the law.

§ 1 DEFINITIONS
Account – regulated in these here terms and conditions free of charge function of the Store (service), that to which the Buyer has the possibility to create his own individual Account in the Store
Buyer – any entity buying from the Store.
Store – the online store Slavica Yarns operated by the Seller under the address http://slavicayarns.pl

§ 2 CONTACT WITH THE SELLER

§ 3 TECHNICAL REQUIREMENTS
1. For the proper functioning of a created Account, you will need:
• An active e-mail address
• A device with an internet connection
• An internet browser capable of operating JavaScript and cookies

§ 4 ACCOUNT
1. The creation of an Account is completely voluntarily and dependent only of the will of the Buyer
2. An Account provides the Buyer with additional possibilities, like: the possibility to view the history of orders placed by the Buyer, tracking of deliveries and the option of editing the personal information of the Buyer himself.
3. In order to create an Account, you need to fill the appropriate form in the Store.
4. At the moment an Account has been created a contract for an indefinite period of time between the Buyer and the Seller is concluded, this contract regards the functioning of the Account on the grounds of these regulations.
5. The Buyer may at any time terminate his account without carrying any fees.
6. In order to terminate an Account send resignation to the Seller on the e-mail address: hello@slavicayarns.pl, this will result in the mediate termination of the Account with the contract regarding the functioning of said Account.

§ 5 COMPLAINTS
1. Complaints regarding the functioning of the Account should be sent to hello@slavicayarns.pl
2. Consideration of complaints will be conducted by the Seller in 14 days.
EXTRAJUDICIAL WAYS OF CONSIDERING COMPLAINTS AND VINDICATING CLAIMS
3. In the case, where the complaints procedure did not bring the results expected by the Consumer, the Consumer may use among others:

§ 6 PERSONAL INFORMATION
1. The Administrator of personal information provided by the Buyer in order to use the Store is the Seller.

§ 7 STIPULATIONS
1. It is forbidden for the Buyer to provide the Store with illegal information.
2. The contract regarding the functioning of the account is concluded in Polish. The Seller (Szymon Jergas in this case) is obligated to provide any Consumer with a contract in English if requested.
3. In the case where some of the important reasons from pint 4 arises, the Seller has the right to change these regulations.
4. The important reasons mentioned in point 3 are:
1. The necessity to adapt the Store to new laws that have an influence on the functioning of the Store
2. In order to raise the security of the provided service
3. Changing the functionality of the Account that arises the need to change the regulations.
5. The Buyer will be informed about loaned changes in the Account regulations at least 7 days before the change will be made, this will be conducted via the e-mail address assigned to the Account.
6. Should the Buyer not agree to the changes, he should inform the Seller about this fact by sending a message to hello@slavicayarns.pl, which will result on termination of the contract regarding the functioning of the Account from the moment the change to the regulations is made, or earlier if the Buyer demands it.
7. In the situation where the Buyer does not object to the changes, it is assumed that he accepts it, which does not pose a hindrance to terminate the Account in the future.
